Some think we will be lucky to have an ‘elected’ president by January 20, the official start of the new regime. Some say both sides have already hired lawyers to have the new GOP 6-3 Supremes decide who won. Last time, GOP Bush had Supreme Scalia on his side. Scalia gave the election to Bush because he claimed, contrary to the Constitution, that FL couldn’t count the votes correctly. Scalia, claiming to know the Constitution, decided for us. But he never showed us voters where it says that the Supremes will choose presidents. He ignored the 12th Amendment: if no winner “the House of Representatives shall choose immediately, by ballot, the President.” Since we don’t know what will happen, we have to go with our best information. The markets may be biased in favor of those who have faster computers, talented analysts, large leverage, more influence, or more insider information. Is a deductible IRA contribution right for you?

The rules changed for 2020: IRA contributions after age 70½ are now permissible.

The SECURE Act repealed the age restriction for Traditional IRA contribution eligibility. Effective for 2020 and later taxable years, individuals with earned income can make Traditional IRA contributions at any age, not just for years before reaching age 70½.

For 2020 and later, there is no age limit on making regular contributions to traditional or Roth IRAs if you have earned income. If you had self-employment income or W-2, that income qualifies. If your spouse had income and you did not, that qualifies too with some limits depending on participation in a retirement plan. Spousal IRAs: If you file a joint return, you may be able to contribute to an IRA even if you didn’t have taxable compensation as long as your spouse did. Each spouse can make a contribution up to the current limit; however, the total of your combined contributions can’t be more than the taxable compensation reported on your joint return. See the Kay Bailey Hutchison Spousal IRA Limit in Publication 590-A. If neither spouse participated in a retirement plan at work, all of your contributions will be deductible. The annual contribution limit for 2020 is $6,000 or $7,000 if you're age 50 or older. For many of my tax clients, this means they can reduce their income and thus their taxes for 2020 due April 15, 2021.

“Guarantee” is the third rail to financial service advertising: it means fraud since there is no ‘guarantee’ in investing. However, consider paying down credit card debt of 12% to 24%. The average rate is 19%. If we pay 24% per year, charged every month, as most cards do, we would be wise to make card interest our ‘investment’ of choice. Most of us are unlikely to earn more than 11% on our investments over time so paying off high interest debt is our best ‘investment’ choice. When we are finished with the debt payment of $100 a month, for instance, we can use that $100 a month to accumulate over $20,000 for our home down payment or college or new car. Instead of making credit card bank investors rich we can help ourselves by investing that monthly payment.

If you feel you need to catch up with your retirement fund you are not alone. Thousands have had their accumulations stopped by the virus pandemic. Some were laid off and some had their employer 401k match stopped. By using the less costly version, you can reach your planned end number even though you have lost some time investing. If you keep giving away that extra 0.5% to your current fund provider, you will need to add an extra $1,400 a year to reach your total target accumulation. Switch to the best low-cost funds available.

Is “modified value investing” right for you?
Expensive advisors at Bank of America claim their “quality plus value” approach would have led to continued outperformance after the financial crisis. Value investing has been lagging the growth style for some time. Value investing is usually means stocks that appear to be trading for less than their intrinsic or book valueValue investors actively ferret out stocks they think the stock market is underestimating. Growth investors tend to favor small, young companies poised to expand, expecting to profit by a rise in their stock prices BofA said its “quality meets value” stock screen turned up names like Intel, Verizon, Coca-Cola and UPS. But BofA is really talking about ‘blue chip’ stocks. The four examples given above are not trading at “less than their intrinsic value.” They are in most consumer and pension portfolios. Since Warren Buffett is known as a value investor, his recommendation for most investors is to stick with the low-cost index and keep the high-cost stock pickers’ fees. We don’t negotiate drug or procedure prices unlike almost every other industry. That is not capitalism, that’s socialism for the rich. Compare what is happening in the financial sector—lower commissions, more access to info, more service choices, lower costs overall. If you have a serious illness, your hospital, doctor and drug bills are full of overcharges that bankrupt most people even when they have great insurance. A ‘free’ virus test can cost $2,121.

Was your advisor advising you during this volatile period?
One-third of investors said their professional was nowhere to be found during the pandemic, according to a new study by J.D. Power. Since most folks who pay advisor fees say they pay so they have someone to discuss their situation with, it seems their advisor is getting paid for no work. Since fees can rob us of up to 63% of our total possible accumulations, it does not seem fair to give up so much for so little. Advisors are not going to know what to do in this market since we have never faced a soaring market with 50 millions out of work. Advisors give out common sense and call it “professional” service. Paying a 1% fee every quarter does not seem terrible until we look at our returns. If we earn 3% total return and we pay 1%, we are not being served well. Is your advisor a trustworthy resource in times of trouble or just an expense? There are alternatives. This is the time to make the change since earnings will be low for the foreseeable future. Unless your advisor cuts costs, you lose.

Tax return due July 15: Extension automatic with form
If you could not meet with your preparer and can’t complete the online tax return using one of the FREE software programs, you can obtain an extension to October 15 just by filing a form with an estimate of what you owe. IRS wants the money—the return can wait—since they have 3 years to find any errors. Fill and print and pay form:  https://www.irs.gov/pub/irs-pdf/f4868.pdf  Paper return refunds delayed again. No folks.
If you cannot pay now, sign a payment plan so you pay over time. Since millions are out of work, this is expected to be big solution. It is unclear what your interest rate will be.

Like papa, Jared uses other people’s money to buy commercial real estate. He pays himself well to create losses. He adds the phantom expense called depreciation (building use and aging). The losses mount up over the years and are added to this year’s loss. He earns $millions but never pays tax. We taxpayers actually give him a refund. Here’s an example from 2015. W-2 income: $198,000. Taxable interest: $536,000. Dividends: $1,000. Capital gains: $974,000. Deductions: Tax losses from real estate and other partnerships: $3.5 million. Tax losses carried forward from previous years: $4.8 million. Total adjusted gross income: Negative $6.6 million. Tax refund $4,000. A new Jared NJ property just so happens to be located on one of papa’s US Opportunity Zones for another tax subsidy in Jared’s future. We have to pay Jared’s share of taxes too.

Prepay your 2019 tuition to maximize your tax credits
If you paid less than $4,000 of tuition for your college student, you can pay for the first semester or quarter of next year's college tuition in December and use that tuition for this year's American Opportunity Credit. However, you want to do the exact opposite if you've already paid more than $4,000 for your college student who qualifies for the American Opportunity Credit. You get no additional benefit from the American Opportunity Credit (max $2,500) if you pay more than $4,000 in tuition each year. In this case, you'd want to wait until January to pay tuition. That way you might increase your American Opportunity Credit next year since you've already maxed out the allowed credit this year. Be sure to show a Form 1098-T from your college or university to your preparer. Credit is partly against tax and partly refund if you owe nothing.

Is final expense ‘senior’ life insurance right for you?
‘Premium never goes up and coverage never goes down.’ ‘You can’t be turned down.’ ‘Don’t leave your family with expenses.’ ‘Only $13.40 a month.’ Let’s look at the caveats for these plans. Coverage is limited for first 2 years and $13.40 buys only a $2,000 benefit at age 60 if you are female. Average age at death is 81 female, 76 male. So $13.40 for 20 years is $3,216. A $2,000 benefit (costing $3,216 or more) will be worth $1,000 in 20 plus years (inflation). You can buy more but the cost goes up at each age when you buy it. If you want to cover funeral and medical expenses for sometime in the future, this is the worst way to do it. No medical means the rate is the highest possible. If you invested your premium in a saving account or CD, you might have $4,400 not $2,000. Bank POD accounts serve this purpose. Clearly this account is for someone who responds to emotional TV appeals. A cost-effective legacy would provide an IRA which pays the beneficiary immediately. This could include funds for the funeral AND help the grandchild. Besides, after you pass, your debts are not owed by your relations.

Did the Trump tax cut for corporations bring all profits home from overseas?
Most businesses are continuing with business as usual when it comes to their valuable intellectual property since the tax law’s provisions aren’t enticing enough for them to keep it at home, according to experts who advise large public companies. It means that other countries ultimately get to collect the billions of dollars of tax revenue generated by many U.S.-made innovations, including life-saving drugs, the algorithms that power social media networks, and the software running computers and smartphones. Apple for instance is still parking its profits in the tiny island off the coast of France. So Trump’s promise of bringing the tax revenue back the US to pay for the huge breaks to individuals like himself has not happened. In fact, all of Trump’s tax cuts have not spurred any growth in tax revenue—tax breaks DO NOT pay for themselves. We taxpayers, who do not have a way to dodge taxes by moving our assets to a foreign country, will have to pay for the wealthy tax breaks eventually. The average tax rates paid by the very wealthiest has fallen in recent years from a peak of 24.1% in 2013 to 22.9 on 2016. For the top 1%, the rate has fallen a full four percentage points below the 26.9%. The deficit is 18% greater than last year!! We can’t spend more than we make and survive.
  

What about your mental fitness—a gym for your brain?
Everyone gets in a rut. ‘Rut-living’ means brain power is reduced—your brain cells are not called to work and so they don’t stay fit. Result: Not Good. Remember the nun study—expanding mental tasks decreased the risk of Alzheimer's disease. Exercise of brain power is necessary just like physical exercise. Focus – avoiding distractions to the mind – seems the first step. I can’t learn how to do my own taxes or how to invest wisely (learn a new language) without FOCUS. Training the brain to stay on one task at a time is hard work like working up to a 10K run. I assume I will need all the brain power I can muster for the decisions about making my money last. First, I take small lists of things I want to do and put them on my calendar. Next, I break the job down into parts and tackle one at a time. No skipping ahead. I set a time. I don’t stop to answer the phone or check email/texts. I take courses that help me FOCUS on the goal. There are many around.

Younger generation does not need financial industry any more
Survey respondents were risk averse and skeptical of the financial planning and investment industries in a survey of 1,000 affluent millennials with at least $50,000 in net worth or $100,000 in annual income. Why? Affluent millennials are still most likely to be do-it-yourself investors, with 35% claiming that they make all their own financial decisions without any help or advice. Another 27% said they consult financial professionals for affirmation, but continue to make their own decisions. Only 15% of affluent millennials retain a professional money manager. According to the survey, 77% view the financial system as rigged to favor the rich and powerful at the expense of ordinary people like them. Millennials also don’t trust recommendations from advisors working on commission: 80% said that they were suspicious of the commission revenue model in the financial services industry. Things have changed since I worked—good!

How do you shield yourself from paying your fair share of tax? The Don’s son in law used the same method: tell the IRS you lost money on real estate ventures. The losses were driven by depreciation, a tax benefit that lets real estate investors deduct a portion of the cost of their buildings from their taxable income every year. In 2015, for example, Mr. Kushner took home $1.7 million in salary and investment gains. But those earnings were swamped by $8.3 million of ‘losses’, largely because of “significant depreciation” that Mr. Kushner and his company took on their real estate, according to the documents reviewed by The Times. Not illegal now but the depreciation deduction often represents a lucrative giveaway to developers like Mr. Trump and Mr. Kushner. Its enormous flexibility allows real estate investors to determine their own tax bills. They pay nothing! 

Why are some states restricting voting?
Why do some in GOP want to stop people voting?  Democracy is about voting, isn’t it? GA is stopping 53,000 people from registering. Since the 2010 election, 23 states have adopted new restrictions on voting, such as stricter voter ID laws, cutbacks to early voting, and aggressive purging of voter rolls. This week, the Supreme Court upheld a voter ID law in North Dakota that could prevent thousands of Native Americans from voting, and the Associated Press reported that Georgia is blocking 53,000 voter registration applications, 70% of which are from African Americans. Some states are making it easier for people to vote and harder for states to gerrymander political districts. There are more Dems than GOP so I assume GOP wants to keep the Dems from voting like in GA. TX has gerrymandered districts so all the Dems are in a few districts.

One analysis shows that if you pay excessive fees for record keeping and investment management you can give up 63% of your potential total savings over time. WOW that is a lot. The answer is switch to an IRA at a low-cost mutual fund firm. You could earn 10-12% instead of 6-8%.

Make your tax refund larger BEFORE December 31
Tax changes you need to know before end of year MAY help increase your refund. You can no longer deduct alimony if divorced after Jan 2019 so finish by Dec so your future payments remain deductible to payer and income to recipient. Medical expenses that exceed 7.5% of AGI are generally deductible. Beginning in 2019, qualified medical expenses will have to exceed 10% of AGI to be deductible. You might want to prepay in 2018 to take the full deduction. Many middle income folks will not itemize since the standard deduction doubled. There is no penalty for canceling medical insurance, so more and more healthy people choose to be uninsured as premiums escalate. The result may be more bankruptcies from medical bills when a illness or accident strikes. If you are one who decides to go ‘naked’ find a bare bones comprehensive policy to avoid the worst disaster.
